Welcome to MerMapp, a mobile application provided by APPEARL LTD (“we,” “us,” or “our”). These terms and conditions (“Terms”) govern your use of the MerMapp application (the “App”), as well as any content or features available through the App.
By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
Use of the App
You may only use the App for lawful purposes and in accordance with these Terms. You agree not to use the App:
In any way that violates any applicable federal, state, local or international law or regulation.
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate APPEARL LTD, a MerMapp employee, another user or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by us, may harm APPEARL LTD or users of the App or expose them to liability.
Accounts
To use the App, you may need to create an account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.
Intellectual Property Rights
The App and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by APPEARL LTD, its licensors or other providers of such material and are protected by Cyprus and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
You may only use the App for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our App, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.
You may print or download one copy of a reasonable number of pages of the App for your own personal, non-commercial use and not for further reproduction, publication or distribution.
Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. APPEARL LTD does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.
Limitation of Liability
In no event will APPEARL LTD, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the App, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of data, loss of goodwill, or loss of any other tangible or intangible property.
Indemnification
You agree to defend, indemnify and hold harmless APPEARL LTD, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, any use of the App’s content, services and products other than as expressly authorized in these Terms or your use of any information obtained from the App.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
Governing Law
These Terms and your use of the App will be governed by and construed in accordance with the laws of Cyprus, without giving effect to any choice or conflict of law provision or rule.
Changes to Terms and Conditions
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and APPEARL LTD with respect to the App, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and APPEARL LTD with respect to the App.

APPEARL LTD ("we", "us", or "our") is committed to protecting the privacy of our users ("you" or "your") when you use MerMapp, a mobile application and desktop software (collectively, the "App"). This Privacy Policy explains how we collect, use, disclose, and protect information about you when you use the App.
By using the App, you consent to our collection, use, disclosure, and protection of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the App.

We take reasonable measures to protect your information from unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.
Your Choices
You may choose to restrict the collection or use of your personal information in the following ways:
You can opt out of receiving marketing communications from us by following the instructions provided in the communications.
You can disable cookies through your browser settings, although this may limit the functionality of the App.
You can request that we delete your personal information by contacting us at support@mermapp.com, although we may need to retain certain information for legal or other purposes.
Children's Privacy
The App is not intended for use by children under the age of 16. We do not knowingly collect personal information from children under the age of 16. If we become aware that we have collected personal information from a child under the age of 16, we will delete it as soon as reasonably possible.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on the App's website and updating the "Last Updated" date at the top of this Privacy Policy. Your continued use of the App after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
